Sri P.K. Upadhyay, learned counsel for the applicant and Sri Ankit Srivastava, learned counsel for the State are present.
At the very outset, learned counsel for the State takes objection that the applicant has filed a writ petition before this Court for quashing of the first information report and stay of arrest which is pending. The reference of the same is stated in paragraph 33 of the affidavit and the order is annexed as Annexure-8 to the affidavit. It is argued that as such the present anticipatory bail application is not maintainable.
Learned counsel for the applicant at this stage prays that the present anticipatory bail application be dismissed as withdrawn.
As prayed, the present anticipatory bail application is dismissed as withdrawn.
