It has been argued by the learned senior counsel for the applicant that applicant is innocent and he has an apprehension that he may be arrested in the abovementioned case, whereas there is no credible evidence against him. The applicant has no criminal antecedents. The first information report of this Court was lodged by the informant alleging that while she was making preparation for competitive examinations, she came in touch with applicant and thereafter on one day, applicant administered some intoxicant in her tea and committed rape upon her and her video was also prepared by him. It was submitted that the allegations regarding rape made by prosecutrix are thoroughly false. It was further submitted that in her statement, recorded under Section 164 Cr.P.C., prosecutrix has admitted that she has married with applicant. The prosecutrix has been living in living relationship with applicant and later on she has married with applicant. Learned senior counsel submitted that prosecutrix herself has concealed the fact that she was already married and even the litigation was going on between the prosecutrix and her earlier husband. In this connection, the statement of her earlier husband of prosecutrix, namely, Sandeep Kumar Chaurasiya was also referred.
