It has been argued by the learned counsel for the applicant that applicant is innocent and he has an apprehension that he may be arrested in the abovementioned case, whereas there is no credible evidence against him. According to the prosecution version, the applicant has shown a residential plot to the complainant for selling the same to the complainant and took Rs. 5 lakhs as part payment but later on he refused to execute the sale-deed of the plot and also refused to return money of complainant. Learned counsel submitted that the allegations made by the complainant are thoroughly false. In fact the first informant has given the said amount of Rs. 5 lakh cash to the applicant for giving the same to the victim of case crime no. 315 of 2021, under Sections 328, 376-D, 346, 506 and 354 IPC for compromise in that case, wherein the son of complainant was one of the accused.
