It has been argued by the learned senior counsel for the applicant that applicant is innocent and she has an apprehension that she may be arrested in the above-mentioned case, whereas there is no credible evidence against her. The applicant has no criminal antecedents and that no coercive process has been issued against the applicant so far. Learned senior counsel submitted that alleged incident has been shown of 28.05.2021 but FIR has been lodged on 01.06.2021. The alleged suicide note has been produced by the complainant and there is no expert evidence that it is in the handwriting of deceased. In fact after death of her husband, due to harassment of complainant and his family members, applicant has left her matrimonial home and that on 19.11.2018 she has remarried with one Rachit Garg. There is absolutely no evidence that applicant has harassed or abetted the deceased to commit suicide and in that connection no overt act has been imputed to applicant. It was further submitted that in fact after second marriage of applicant, the deceased was helping her but his sons were not agree for the same and deceased has committed suicide due to that reason. Referring to alleged suicide note of deceased, it was pointed out that deceased has made allegations against Amar Gupta and that no case under Section 306 IPC is made out against the applicant. The applicant undertakes to co-operate during investigation and trial and she would appear as and when required by the investigating agency or Court. It has been stated that in case, the applicant is granted anticipatory bail, she shall not misuse the liberty of bail and will co-operate with the investigation and would obey all conditions of bail.
