Heard learned counsel for the applicant and learned A.G.A. for the State.

This application under Section 483 Cr.P.C. has been filed with a prayer to direct the learned Metropolitan Magistrate-VII, Kanpur Nagar to decide the Complaint Case No.691 of 2020 (Manoj Singh Vs. Saurabh Dwivedi) under Section 138 Negotiable Instrument Act, Police Station Kalyanpur, District Kanpur Nagar expeditiously within a stipulated period.

It has been submitted that the complaint case is pending since 2020 and still the process is going on and the accused has not appeared so far despite summoning order dated 3.3.2020.

The grounds are sufficient. The trial court is directed to make all endeavor to ensure the appearance of the accused before the court. The trial court is empowered to take action against the process servicing agencies as well. The trial court is expected to issue directions to the police authorities for the service of bailable warrant issued by the court. After appearance of the accused / opposite party no.2, all endeavor should be made to decide the case within six months.

With the above observations, the application stands disposed of.
