Heard Mr. Rajesh Kumar Singh, the learned counsel for applicant and the learned A.G.A. for State. Perused the record.

Present application under Section 482 Cr.P.C. has been filed challenging the charge-sheet dated 25.12.2020, the Cognizance Taking Order/Summoning Order dated 26.02.2021 passed by Additional Session Judge/Special Judge SC/ST Act (prevention of atrocities act), Kushinagar at Padrauna in consequential Special Sessions Trial No. 127 of 2021 (State Vs. Jagdish Yadav) arising out of case crime no. 384/2020 under Sections 147, 323, 504, 506, 452, 427, 325, 188 I.P.C & 3(1) (Da) & 3 (1) (Dha) SC/ST Act, P.S Hata, District Kushinagar as well as entire proceeding of aforementioned Special Sessions Trial now pending in the court of Additional Sessions Judge/Special Judge SC/ST Act (prevention of atrocities act), Kushinagar at Padrauna.

After some arguments, learned counsel for the applicant wants to withdraw the application with liberty to appellants file a bail application before the court of competent jurisdiction.

In view of the above, the application is disposed of as withdrawn with liberty to the applicants to file an appropriate application for bail before the court below in terms of the decisions rendered in Satender Kumar Antil Vs. Central Bureau of Investigation and another, Special Leave to Appeal (Crl.) No (s) 5191 of 2021 decided on 07.10.2021.
