Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The present application under Section 482 Cr.P.C. has been filed with a prayer to issue direction to the court below to decide the Misc. Case No. 1792 of 2020, under Section 156(3) Cr.P.C., Police Station- Sikandra, District- Agra, pending in the court of Special Chief Judicial Magistrate, Agra, within a stipulated period.

It is submitted by learned counsel for the applicant that the applicant has fined an application under Section 156(3) Cr.P.C. against opposite party nos. 2 & 3 and four constables on 13.01.2022 in the court of Special Chief Judicial Magistrate, Agra and police report was called on 13.01.2022, thereafter, several dates were fixed in the matter. The opposite party no.2 is a Sub-Inspector and under his influence there is no hope of early decision. On account of pendency of present case the applicant is facing unnecessary harassment and mental agony.

Having heard the submissions advanced by learned counsel for the applicant as well as learned A.G.A., considering the facts and circumstances of the case and the averments made in the application, the court of Special Chief Judicial Magistrate, Agra is directed to decide the aforesaid case and conclude the same expeditiously strictly in accordance with law, preferably within a period of one month from the date of production of a certified copy of this order, if there is no legal impediment.

With the aforesaid directions, the present application under Section 482 Cr.P.C. application is finally disposed of .
