Heard Mr. Deepak Kumar Verma, Advocate holding brief of Mr. Arvind Kumar Verma, learned counsel for applicant and learned A.G.A. for State.
At the very outset, learned counsel for the applicant submits that present application is not maintainable, inasmuch as order dated 10.12.2021 passed by Court below whereby application under Section 156(3) Cr.P.C. filed by applicant has been rejected, is a final order and before revisable in terms of Section 397/401 Cr.P.C. He, therefore, submits that present application be dismissed as not pressed with liberty to the applicant to file criminal revision.
Learned A.G.A. does not oppose the prayer made by learned counsel for applicant.
In view of above, this application is dismissed as not pressed with liberty to the applicant to file criminal revision.
Certified copy of impugned order shall be returned to learned counsel for applicant after obtaining photo copy of same to be kept on record.
