Heard learned counsel for the applicant, learned AGA for the State and perused the record.

This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the Additional Chief Judicial Magistrate, Khurja, Bulandshaher to decide the Complaint Case No. 711 of 2021 (M/s Shakti Ceramics Vs. Ms. Aarti Industries), under Section 138 of Negotiable Instruments Act, Police Station Khurja, District Bulandshaher within stipulated period.

Learned counsel for the applicant has submitted that applicant is the complainant in the present case and he has filed a complaint under Section 138 of the N.I. Act on 13.09.2021 and since then, proceeding has been pending and has been lingering-on, on one pretext or the other.

In view of the provision of Section 143(3) of the Negotiable Instruments Act, learned court below is expected to make all endeavours to decide the aforesaid complaint case as expeditiously as possible, preferably within a period of six months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.

With the aforesaid direction, this application under Section 482 CrPC is finally disposed off.
