Heard learned counsel for applicants, learned AGA for State and perused the record.
This application under Section 482 Cr.P.C. has been filed by the applicant with a prayer to quash the non-bailable warrant dated 24.08.2022 passed by Additional Chief Judicial Magistrate, Kasganj in Criminal Case No. 2520 of 2021 (State Vs. Neeraj and Others), arising out of Case Crime No. 184 of 2019, under Sections 147, 148, 149, 307, 332, 333, 353, 34 I.P.C., Police Station Sahawar, District Kasganj.
Learned counsel for the applicants, after arguing for some time, has submitted that present application may be dismissed as not pressed with liberty to file a bail application, which may be decided in view of law laid down by Hon'ble Supreme Court in the case of "Satender Kumar Antil Vs, Central Bureau of Investigation and another, Special Leave to Appeal (Cri) No. 5191 of 2021", to which learned A.G.A. has no objection.
In view of the above, prayer for quashing the impugned proceedings is refused. So far as other prayer is concerned, it is provided that in case, the applicants namely appear before the trial court within three weeks from today and apply for bail, the same shall be decided expeditiously, in view of the law laid down by Hon'ble Supreme Court in Satender Kumar Antil's case (supra).
This application under Section 482 CrPC is accordingly disposed off.
