Heard the learned counsel for the applicant and learned AGA for the State.

This application has been filed with the following main prayer :-

"Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to allow the petitioner to submit a personal bond and two sureties in all the cases, (mentioned in the Para-4 of memo of petition), in the interest of justice."

It has been submitted by the learned counsel for the applicant that the applicant has been falsely implicated in five criminal cases detail of which has been given in para 4 of the petition.

Para 4 of the writ petition is being quoted hereinbelow :-

" That the accused/applicant has been granted bail by the learned courts below in all four cases, the details of cases are as under ;-

(i) Case Crime No.20/2019, under Sections 379, 411, 420, 467, 468 IPC, P.S. Ashiyana, District Lucknow.

(ii) Case Crime No.253/2019, under Sections 379, 411 IPC, P.S. Para, District Lucknow.

(iii) Case Crime No.145/2019, under Sections 379, 411 IPC, P.S. Mohanlalganj, District Lucknow.

(iv) Case Crime No.182/2019, under Sections 411, 413, 419, 420, 467, 468, 471 IPC, P.S. Mohanlalganj, District Lucknow."

It has been submitted by the learned counsel for the applicant that the applicant has been bailed out in all such cases but he belongs to a very poor family so he is unable to manage ten persons for surety before the learned trial court.

The Hon'ble Supreme Court in Special Leave to appeal (Criminal ) No.8914- 8915 of 2018, Honey Nishad alias

Mohd. Imran alias Vicky vs. State of U.P. and Others had directed that the petitioner who was an accused in 31 cases be released on bail taking one personal bond and two sureties.

A prayer has been made by the learned counsel for the applicant that the applicant be also given the benefit of judgment rendered by the Hon'ble Supreme Court in the case of Honey Nishad (supra).

This application is disposed of with the direction to the learned trial court to accept one personal bond and two sureties to its satisfaction in one criminal case against the applicant and such personal bond and sureties shall hold good in all the other three cases in which the applicant has been granted bail.
