The opposite party no.2 has specifically pleaded in the plaint filed by her in Regular Suit No. 1638 of 2017 filed under Section 13-B of the Hindu Marriage Act that she has entered into an agreement with her husband- applicant under which she will receive a sum of Rs.10 lacs from the applicant towards her maintenance, streedhan, alimony and other damages out of which a sum of Rs. 5 lacs was received by her on the date of filing of the plaint and she specifically pleaded that she will render all co-operation for closure of all the cases filed by her including the cases arising out crime no.50 of 2015 under Sections 498A, 323, 504, 506, 406 IPC and Section 3/4 of D.P. Act, P.S. Mahila thana, district Lucknow, case under Section 12 of the Protection of Women from Domestic Violence Act, case arising out of crime no.225 of 2016 under Section 406 IPC, P.S. Madiyaon, Lucknow and the case under Section 125 Cr.P.C. pending in the Family Court and she received the balance amount of Rs. 5 lacs pursuant to the aforesaid agreement by means of another bank draft dated 28-06-2016. A decree has been passed by the learned Additional Principal Judge, Family Court decreeing the aforesaid suit no.1638 of 2017 filed under Section 13-B of the Hindu Marriage Act.
