Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the learned Additional Principal Judge-IIIrd, Deoria to decide the Maintenance Case No. 888 of 2020 (Aasmeena Khatoon and others Vs. Munna), under Section 125 CrPC, Police Station Tarkulwa, District Deoria within stipulated period.
Learned counsel for the applicant has submitted that the applicant in the present case is the wife of opposite party no.2 and she has filed an application for grant of maintenance under Section 125 CrPC on 19.10.2020, however since then, the proceeding has been lingering-on, on one pretext or the other and the same has not yet been disposed of till date.
In view of the above, learned court below is expected to make all endeavours to decide the aforesaid maintenance case as expeditiously as possible, preferably within a period of two months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
