Heard learned counsel for the applicant, learned AGA for the State and perused the record.

This application under Section 482 CrPC has been filed by the applicant with a prayer to direct the learned Judicial Magistrate, Sant Kabir Nagar to decide the Complaint Case No. 164 of 2016 (Pragya Vs. Ajeet Rai and Others), under Section 498-A IPC and 3/4 of D.P. Act, Police Station Khalilabad, District Sant Kabir Nagar within stipulated period.

Learned counsel for the applicant has submitted that applicant is the wife of opposite party no.3 and she had filed a complaint case against her husband and his family members under Section 498-A IPC and 3/4 of D.P. Act. On the basis of the said complaint, opposite party nos. 2 and 3 were summoned vide order dated 17.02.2017, however, despite lapse of more than five years, proceedings is still pending and has not reached its logical conclusion and has been lingering-on, on one pretext or the other.

In view of the above, learned court below is expected to make all endeavours to decide the aforesaid complaint case as expeditiously as possible, preferably within a period of eight months from the date of receipt of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid complaint case.

With the aforesaid direction, this application under Section 482 CrPC is finally disposed off.
