Heard learned counsel for the applicants, learned A.G.A. and perused the record.

This applicants, through the present application under section 482 Cr.P.C. has invoked the inherent jurisdiction of this Court with a prayer to quash the entire proceeding of Criminal Case No. 37246 of 2021 (State Vs. Smt. Sithlesh Singh and others) including cognizance taking order dated 01.03.2021 and chargesheet dated 01.02.2021 arising out of Case Crime No. 367 of 2018, under sections 419, 420, 467, 468, 471, 506 IPC P.S. Kalyanpur, District- Kanpur Nagar, pending in the court of Additional Chief Metropolitan Magistrate-II, Kanpur Nagar.

Learned counsel for the applicants contends that applicants have been falsely implicated in this case on account of ulterior motive. It is next contended that the dispute, if any, between the parties, is private and civil in nature, which has been dragged into criminal litigation and cannot be countenanced by this Court.

Per contra, learned A.G.A. has opposed the prayer of this application.

After having heard the learned counsel for the parties and perused the impugned order as well as material brought on record, I am of the view that impugned order is based upon relevant consideration and supported by cogent reason, the same does not suffer from any irregularity, illegality or jurisdictional error, hence, no interference is required by this Court. The prayer for quashing the impugned order is refused.

The application lacks merit. It is liable to be dismissed and is, accordingly dismissed.
