Heard learned counsel for applicant and learned A.G.A. for State.

This application under Section 482 Cr.P.C. has been filed with a prayer to direct the Civil Judge (Junior Division)/FTC, Judicial Magistrate, Ghaziabad Court, Ghaziabad to decide the Complaint Case No. 553/2015, New Number 4396/2017 (Kapil Kumar Nain Vs. Anup Kumar Srivastava), under Section 138 N.I. Act, P.S.- Kavinagar, District- Ghaziabad, within stipulated period.

It has been contended by learned counsel for applicant that complaint case relates to the year 2015 and up till now accused is not appeared before the court. Progress of the case is very slow.

After hearing the learned counsel for the parties and after perusing the material on record, no useful purpose would be served in keeping the petition pending which is finally disposed off with a direction to court below to consider and decide the Complaint Case No. 553/2015, New Number 4396/2017 (Kapil Kumar Nain Vs. Anup Kumar Srivastava), under Section 138 N.I. Act, P.S.- Kavinagar, District- Ghaziabad, strictly in accordance with law after hearing the parties and without granting any unnecessary adjournment to either the parties, expeditiously preferably within six months from the date of production of a certified copy of this order before him, after assuring the attendance of the accused.

With the aforesaid direction, the instant application under Section 482 Cr.P.C. is finally disposed of .
