The present application under Section 482 Cr.P.C. has been filed to quash the charge sheet dated 23.02.2018 and cognizance order dated 23.01.2019 under Section 135 of the Electricity Act, arising out of Case Crime No.13 of 2018, Police Station Bansdeeh, District Ballia.

It has been stated by Shri Chetan Chatterjee, counsel for the Power Corporation of U.P. that the offence is compoundable under Section 152 of the Electricity Act.

The counsel for the applicant states that the applicant is ready to participate in the proceeding regarding compounding of the offence.

Considering the submissions made by learned counsel for the parties, the applicant is directed to file an application within three weeks from today before the Court concerned for settlement of dispute of electricity dues between the applicant and opposite party no.2. In case, such application is filed, the court below shall consider and decide the compounding proceedings by passing a reasoned and speaking appropriate orders within three weeks thereafter in accordance with law positively.

For a period of six weeks, no coercive action shall be taken against the applicant.

With the above direction, this application is finally disposed of.
