By means of this application, applicant has prayed for quashing the order dated 29.4.2022 passed by Additional District and Sessions Judge Court No.12, Allahabad in Bail Cancellation Application No.62 of 2022 (Sahdev Singh Vs. State of U.P. and another) arising out of Case Crime No.56 of 2018, under sections 498A, 323, 504, 506, 354 I.P.C. and section 3/4 D.P.Act P.S.Phoolpur, district-Allahabad and order dated 2.5.2022 passed by Additional Chief Judicial Magistrate 7th Allahabad in Criminal Case No.1817 of 2018 in the aforesaid case crime number.
Learned counsel for applicant undertakes that he will appear before the court concerned on 19.10.2022 and file appropriate application to recall the non bailable warrant and bail application if so advised and trial court shall decide the application and bail application taking note of the judgment passed by Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.
Non bailable warrant issued against the applicant shall be kept in abeyance till 18.10.2022.
In case the applicant does not appear before the court concerned on 19.10.2022 during pre lunch session, police authorities shall execute non bailable warrant, arrest him and produce before the court concerned on same day.
With the aforesaid direction, this application is disposed of.
