Heard Sri Ram Raj Pandey, the learned counsel for applicant, the learned AGA for State and Sri Ravendra Singh, the learned counsel for opposite party no.2.
At the very outset, the learned counsel for applicant submits that he be permitted to withdraw the present application with liberty to file fresh inasmuch as there are inherent defects in the present application which cannot be cured by filing a supplementary affidavit or an amendment application.
Learned AGA for the State and learned counsel representing opposite party no.2 have no objection to the prayer, made by learned counsel for applicant.
In view of above, present application is dismissed as not pressed with the liberty aforesaid.
The certified copy of the impugned order be returned to learned counsel for the applicant after obtaining a photocopy of the same to be kept on record.
