Heard Mr. Ratnesh Kumar Tiwari, the learned counsel for applicants and the learned A.G.A. for State.

This application under section 482 Cr. P. C. has been filed challenging the charge sheet No. 176 of 2021 dated 14.09.2021 submitted in Case Crime No. 182 of 2021, under Sections 143, 149, 149, 323, 324, 504, 506 IPC, Sections 3 (1) (r), 3 (1) (s) and Section 3 (2) (5a) of S.C./S.T. Act, P.S. Chajlait, District Moradabad, the Cognizance Taking Order/summoning order dated 29.9.2021 passed by Special Judge S.C./S.T. Act, Moradabad, in consequential Special Sessions Trial No. 982 of 2021 (Computerized No. UPM 0010069442021) (State Vs. Mayank Gurjar and others), arising out of aforementioned case crime number as well as entire proceedings of aforementioned Special Sessions Trial, now pending in the Court of Special Judge S.C./S.T. Act, Moradabad.

After some arguments, learned counsel for the applicants wants to withdraw the application with liberty to applicants to file their bail applications before the court of competent jurisdiction.

In view of the above, this application is disposed of as withdrawn with liberty to the applicants to appear before court below and file an appropriate application for bail, which shall be decided by court below in the light of decision rendered in Satender Kumar Antil Vs. Central Bureau of Investigation and another, Special Leave to Appeal (Crl.) No (s) 5191 of 2021 decided on 07.10.2021.
