Counter affidavit filed today by Sri Anil Shukla, Advocate, on behalf of the opposite party no.2, is taken on record.

Heard learned counsel for the applicants, Sri Anil Shukla, learned counsel for the opposite party no.2 and learned AGA on behalf of the State.

This application under Section 482 Cr.P.C. has been filed to quash the entire criminal proceeding including charge-sheet dated 15.12.1993 in Case No.3007 of 2007 (State vs. Radhemuni Yadav and others) arising out of Case Crime No.670 of 1993, under Section 394 I.P.C., Police Station Khuldabad, District Allahabad.

Counsel for the petitioners at the outset has submitted that both the parties have made settlement outside the Court and same has been filed before the Additional Chief Judicial Magistrate, Court No.7, Allahabad, which is pending. He seeks direction from this Court that case be decided in terms of compromise.

Sri Anil Shukla, learned counsel appearing for the opposite party no.2 has no objection and he has filed counter affidavit today in which he has admitted that on account of compromise, criminal case pending against the applicants be quashed.

Learned AGA has also no objection if direction is issued to the trial court to decide the case in terms of compromise.

Upon considering the facts and circumstances of the case, court below is directed to decide the aforesaid case in terms of compromise filed by the parties in accordance with provision of Section 320 Cr.P.C. expeditiously.

The application u/s 482 Cr.P.C. is accordingly, disposed of.
