Heard learned counsel for the petitioner.

Present petition has been filed with following prayer:-

"(i). Issue a writ, order or direction in the nature of mandamus directing the Presiding Officer Commercial Court Gautam Budh Nagar to decide Execution Case No. 458 of 2019 CNR N. UPGB 01-006462 of 2019 (Vikas Sahkari Avas Samiti Ltd. Vs. Harish Chandra Kotnala), within stipulated period."

In the facts and circumstances of the case, the present petition is finally disposed of with direction to the Presiding Officer Commercial Court Gautam Budh Nagar to expedite the hearing of the aforesaid case and decide the same, in accordance with law, expeditiously, maximum within a period of six months from the date of production of certified copy of this order after providing opportunity of hearing to all concerned and without granting any unnecessary adjournment to either of the parties. In case adjournment is granted, Court shall record the reason for the same.
