Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
This Application under Section 482 Cr.P.C. has been filed with a prayer to direct the respondent No. 2 to decide the application dated 24.04.2019 pending before the Additional District Judge 2nd, Allahabad (In Appeal No. 194 of 2017, Vaibhav Singh and Others Vs. Dhanbeer Singh) within stipulated period.
Learned A.G.A. opposed the aforesaid prayer.
Learned counsel for the applicant submitted that aforesaid Application is pending since 2019, more than 2 years have passed and that application has not culminated to its logical conclusion.
Keeping in view the period of pendency of the case, it is directed that court below/transferee court shall make all endeavour to decide this application dated 24.04.2019 pending before the Additional District Judge 2nd, Allahabad (In Appeal No. 194 of 2017) expeditiously preferably within a period of two months from today, if there is no legal hurdle, without permitting undue adjournments to either sides.
With this direction, this application is disposed of without issuing any notice to O.P. No.2 as it is an innocuous order. If the O.P. No.2 feels aggrieved, he/she may approach this Court.
