Heard learned counsel for the petitioner and learned AGA for the State and perused the record.

This petition under Article 227 of Constitution of India has been filed with a prayer to set-aside the impugned judgment/order dated 20.02.2020, passed by learned Session Judge, Lalitpur, in Criminal Revision No.05 of 2020 (CNR UPLL01-000291-2020 J.O. Code-UP 5431)(Sanjay and others Vs. State of U.P. & another).

Vide order dated 15.06.2020 this Court was pleased to issued notice to the opposite party nos.2 to 10 and opportunity of filing counter affidavit and rejoinder affidavit was also given, but the said order has not been complied with.

Learned counsel for the petitioner submitted that he is not pressing his prayer for quashing of the judgment/order dated 20.02.2020 and confine his prayer for direction to the court concerned to expeditiously proceed in the complaint case, in view of the impugned order dated 20.02.2020.

Considering the submission made by learned counsel for the petitioner, the prayer for quashing the impugned order dated 20.02.2020 is hereby refused and the petition is dismissed in this respect.

Considering the second submission made by learned counsel for the petitioner, it is directed that the court concerned will proceed expeditiously in the matter and pass the appropriate order on the complaint of the petitioner, in view of the revisional court order dated 20.02.2020, preferable within one month from the date of production of certified copy of this order before him.
