Heard Sri Suresh Chand Rathour, learned counsel for the petitioner, Sri Gopal Krishna Pathak, learned A.C.S.C. for the respondent nos.1 to 4 and Sri Dilip Kumar Pandey, learned counsel for respondent no.5 and perused the record.

The instant petition has been filed under Article 226 of the Constitution of India on behalf of the petitioner with the prayer to issue writ, order or direction in the nature of mandamus commanding the respondent no.3- Sub District Magistrate/UpZiladhikari, Tehsil Unchahar, District Raebareli for granting license of fair price shop dealer to the petitioner in respect of the proposal dated 28.6.2022 passed in favour of the petitioner, in regard to the Gram Panchayat Shukrullapur, Block and Tehsil Unchahar, District Raebareli. The copy of the said proposal is annexed as annexure-1 to the writ petition along with G.O. dated 5.8.2019, within stipulated period of time.

It is submitted by learned counsel for the petitioner that the proposal was made on 28.6.2022 by Gram Sabha, which is pending for approval before respondent no.3. He has further submitted that the petitioner has moved a representation before the Block Development Officer, which was forwarded to the respondent no.3 with the report that the defects have been removed.

Learned A.C.S.C. has submitted that this application may be disposed off at this stage with a direction to respondent no.3 to proceed for approval of proposal.

In above circumstances, the instant petition is disposed off with a direction that the respondent no.3 shall proceed for approval of the proposal dated 28.6.2022 within a period of one month from the date of receipt of the copy of this order.
