Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case with a view to cause unnecessary harassment and to victimize him. He has further stated that as per the allegations leveled in the FIR, there are general allegations and no role has been assigned to any accused persons, whatsoever, but as an improvement, later on in the statement of the victim recorded under Section 161 Cr.P.C., the role of the applicant has been assigned having fired at the first informant. As per the the allegations in the FIR, the role of the applicant is at par with that of the co-accused person, who has been enlarged on bail by a co-ordinate Bench of this Court dated 29.6.2021 passed in Bail No. 7669 of 2020. Several other submissions have been made on behalf of the applicant to demonstrate the falsity of the allegations made against him. The circumstances which, as per counsel, led to the false implication of the applicant have also been touched upon at length. It is further stated that there is no criminal history of the applicant. The applicant is languishing in jail since 15.7.2020. There is a long incarceration period i.e. more than two years. In case, the applicant is released on bail, he will not misuse the liberty of bail.
