Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The present bail application under Section 439 Cr.P.C. has been filed by the applicant seeking bail in FIR No.414 of 2021, under Sections 302, 394, 411, 34 IPC, Police Station Deeh, District Raebareli.

Main accused in this case, Ankit Singh is real nephew of the deceasedRadha Singh. It is alleged that when the deceased-Radha Singh and his sister's daughter-Sejal Singh, aged around 15 years, were alone on 3031.10.2021, the complainant who happens to be the son of the deceased, Radha Singh got information that they have been killed in the night. The accused-applicant is the friend and accomplice of the main accused. The motive behind the crime allegedly was robbing the deceased of her jewellery and cash by her real nephew inasmuch as the deceased was maternal aunt of the main accused-Ankit Singh. From the possession of the accused-applicant, some ornaments belonging to the deceased, cash of Rs.10,000/- and a wrist watch of the deceased were recovered, which were identified by the complainant, son of the deceased.

Looking at the heinousness of the offence in which two hapless victims, one widow lady and a young girl of 16 years, have been mercilessly killed allegedly by the accused-Ankit Singh and the accused-applicant and two others, this Court does not consider it to be a fit case for enlarging the accused-applicant on bail at this stage. This bail application is thus, rejected .
