Anoop Verma was knowing about the assailants. Sri Singh has further drawn attention of this Court towards Annexure No.13 of the bail application, which is the statement of the father of the victim, who is informant and has stated that after knowing the fact that anyone had attacked upon his son by Banka on 18.11.2021, he took his son to the hospital. Sri Singh has submitted that as per the prosecution story so narrated in the FIR, the alleged incident took place on 17.11.2021 but in his statement (Annexure No.13), the informant is saying that his son was attacked on 18.11.2021. Further attention has been drawn towards Annexure No.17 of the bail application, which is the statement of alleged eye witness Anoop Verma, who has also stated the same story that someone attacked upon his relative Mohit Awasthi, the victim (since deceased), on 18.11.2021 and they took the victim to the hospital. However, such eye witness in his further statement (Annexure No.10) has stated that he saw the incident in question, which had taken place on 17.11.2021. As per his statement, one young person was attacking upon the victim. However, no such allegation of attack etc. has been attributed to the present applicant as the present applicant is father of the accused, who is said to be young person. In his statement, he has further stated that he identified those persons when their photographs were published in the newspaper.
