Heard Shri Satyam Singh, learned Counsel for the applicant and Shri Rajesh Kumar, learned A.G.A. for the State.

The learned Counsel for the petitioner says that the present applicant is languishing in jail since 10.04.2022 in case crime no. 0069 of 2020 under Sections 498A, 304B IPC and 3/4 D.P. Act, 1961, Police Station - Jahangirabad, District - Barabanki.

This Court has passed the order dated 12.05.2022 in the following terms:-

" Heard learned counsel for the applicant and the learned Additional Government Advocate for the State.

This is short term bail application filed on the ground that real brother of the present applicant has been under gone with the surgery of Kidney Transplant where the mother is a donor. Presently, the condition of brother of the present applicant is critical and is needed specialized medical care, for that, the presence of the present applicant would be required as there is no one in the family to look after him.

List this case on 19.05.2022 as fresh to enable the learned Additional Government Advocate to seek complete written instructions in the matter so that the short term bail application may be heard and disposed of on the next date."

In compliance of the aforesaid order, Shri Rajesh Kumar has apprised that he has received complete information through I.O. concerned in terms of the order of this Court dated 12.05.2022.

As per information, the wife of his brother who has been undergone with the surgery of Kidney transplant is taking care of him. Besides, the married sister of the present applicant, Smt. Maya, who is living with the family members of the present applicant, is also taking care of her brother and mother. Therefore, as per Shri Rajesh Kumar, it cannot be said that there is no one in the family to look after the ailing brother and mother of the present applicant. Besides, as per Shri Rajesh

Kumar, this fact of the kidney transplant has been considered in the bail rejection order dated 13.04.2022.

Considering the aforesaid facts and circumstances, the short term bail application is rejected.
