1. The petition has been filed under Section 482 CrPC for quashing proceeding of Criminal Case No.6484 of 2020 State versus Durga Prasad and others, pending in the court of Addl. CJM-III, Sultanpur.

2. Heard learned counsel for the petitioners and learned A.G.A. for the State.

3. Learned counsel for the petitioners, after arguing at some length, submits that he does not want to press the relief for quashing of the impugned proceedings; rather he may be permitted to file an anticipatory bail application before the trial Court, which may be decided expeditiously, to which learned A.G.A. has no objection.

4. In view of the above, the prayer for quashing of the impugned proceedings is refused.

As regards other prayer, the petitioners are permitted to move an anticipatory bail application within ten days from today before the court below. In case such an application is filed within ten days from today, the same shall be considered and disposed of expeditiously, in accordance with law. Prayer for interim direction, if any shall be considered on the very first day.

5. The petition is disposed of accordingly.
