Heard the learned counsel for the petitioner and Sri Parmanand Asthana, learned counsel representing respondent nos. 1 and 2.

Learned counsel for the petitioner confines his prayer for issuing a direction to the Joint Housing Commissioner / Housing Commissioner, Uttar Pradesh Awas Evam Vikas Parishad to decide his application/representation dated 07.12.2021 annexed as annexure-5 to the affidavit filed in support of the writ petition.

However, without entering into the claim of the petitioner, this writ petition is finally disposed of with a direction to the Joint Housing Commissioner / Housing Commissioner, Uttar Pradesh Awas Evam Vikas Parishad to decide the application/representation dated 07.12.2021 filed by the petitioner, if the same has been received in their office, within a period of two months from the date of production of a certified copy of this order .

We make it clear that while considering the said application, the Joint Housing Commissioner / Housing Commissioner, Uttar Pradesh Awas Evam Vikas Parishad shall also consider as to whether any such application under Section 128A of U.P. Housing Co-operative Societies Act would be maintainable or not.
