In compliance of Court's order dated 14.10.2022, Shri Ashok Priyadarshi, Superintendent of Police and Shri Raghwan Kumar Singh, Station House Officer have filed their personal affidavits by Shri Ganesh Gupta, learned Brief Holder for the Staterespondent, the same is taken on record.
The present habeas corpus petition has been registered on the basis of letter petition filed by Ram Naresh Sonkar father of detene, namely, Rajendra Kumar Sonkar.
Learned Brief Holder states that present habeas corpus petition has been filed on the ground that earlier younger son of the petitioner, namely, Sunil was taken by the concerned police station and when the elder son has gone to enquire whereabouts of his brother, then he was taken in the police station concerned. He further states that Rajendra Kumar Sonkar was wanted in Case Crime No.690 of 2022 for the offence under Section 379 I.P.C., Police Station Kotwali Nagar, District Raebareli, for which brother of the petitioner was taken to the concerned police station but the Sunil, who was a younger son of the petitioner- Ram Naresh Sonkar was allowed to go but the whereabouts of the accused petitioner- Rajendra Kumar Sonkar could not be traced out.
Thus, the present habeas corpus petition requires, no further interference by this Court.
In view of the above, the instant habeas corpus petition is consigned to record .
