Heard learned counsel for the applicant as well as learned Additional Government Advocate, representing respondent no. 1-State, and gone through the record.

By way of this application under Section 482 CrPC, the applicant has prayed for quashing of charge-sheet filed in Crime No.0611 of 2011, under Sections 419, 420, 467 and 468 IPC, Police Station Mohammadpur Khala, District Barabanki. Further prayer has been made for staying further proceedings of Case No.623 of 2013, pending in the Court of Additional Chief Judicial Magistrate, Court No. 12, Barabanki.

After some argument, learned counsel for the applicant submits that this application may be disposed of with a direction to the trial Court to consider bail application of the accused-applicant in light of the order passed by the Supreme Court reported in (2021)10 SCC 773 (Satender Kumar Antil Vs. Central Bureau of Investigation & Ors).

Considering the aforesaid submission, this application is disposed of with a liberty to the applicant to surrender before the trial Court and apply for regular bail within ten days from today. In case the applicant does so, his bail application shall be considered and decided by the learned trial Court, in accordance with law, taking into consideration the order passed by the Supreme Court in Satender Kumar Antil Vs. Central Bureau of Investigation & Ors (supra). Order Date :- 12.7.2022
