Heard and perused the record.

This criminal revision under Section 19(4) of the Family Courts Act has been filed, impugning the order dated 02.12.2021 passed by the learned Additional Principal Judge-I, Family Court, Barabanki in Criminal Misc. Case No.547 of 2014 (Smt. Mithlesh Kumari and another Vs. Chanshyam) whereby maintenance @ Rs.4,000/- and Rs.2,000/- per month has been awarded in favour of respondent nos. 2 and 3, who are wife and minor son of the revisionist, from the date of their moving application under Section 125 CrPC.

This Court has considered the order impugned.

The learned Family Court has taken into consideration income of the revisionist, life-standard, facts and circumstances of the case as well as evidence brought on record and thereafter has awarded the maintenance in favour of the wife and minor son, as mentioned above. This Court does not find that the learned Family Court has committed any error of law or jurisdiction, while awarding the maintenance amount of Rs.4,000/- and Rs.2,000/- per month to respondent nos. 2 and 3, who are wife and son of the revisionist.

Thus, this revision fails and is, accordingly, dismissed.

However, the revisionist is allowed to pay arrears of maintenance in six equal quarterly installments in one and a half years from today, subject to he continues to make payment of the maintenance amount regularly, as awarded by the learned Family Court.
