- Heard learned counsel for the accused-applicant as well as learned Additional Government Advocate and gone through the entire record.
- By means of this application under Section 439 CrPC, the accused-applicant seeks bail in FIR No.0133 of 2021, under Sections 147, 148, 149, 308, 323, 506, 304 and 324 IPC lodged at Police Station Sadarpur, District Sitapur.
- It is alleged that when deceased, Sanjay Chauhan along with his wife, Sangeeta were present in their agricultural field, the accused-applicant and co-accused, named in the FIR, came there and assaulted them with knife and Banka . The accusedapplicant was allegedly armed with knife. Sangeeta, wife of the deceased received following injuries:-
i. incised wound 3cm x 1cm x muscle deep present on lateral aspect of right arm, 15cm below right shoulder joint. Margins are clear cut.
ii. incised wound 3.5cm x 1cm x muscle deep present on posterior aspect of right arm at the level of injury no. 1. Margins are clean cut.
