Heard learned counsel for the petitioner, Sri S. D. Kautilya, learned counsel for respondent nos.2 and 3 and learned Standing Counsel for State-respondent no.1
The instant petition has been filed seeking following reliefs :
"(i) Issue a writ, order or direction in the nature of ceritorari quashing the House Tax bill of financial year 2020-21, issued on 09.06.2020 by the Respondent Corporation (Annexure no.3) to this writ petition.
(ii) Issue a writ, order or direction in the nature of mandamus directing the respondent no.2 to decide the objection dated 5.11.2020 and provide fresh Assessment to the petitioner."
Learned counsel for the petitioner is disputing the amount of house tax shown a arrears vide Annexure no.3 to this writ petition. Submission of learned counsel for the petitioner is that he has already deposited certain amount, as such, he has moved representation dated 05.11.2020, for adjusting the amount and to provide fresh assessment bill, which is still pending for consideration.
Learned counsel appearing on behalf of respondent nos.2 and 3 submits that respondent authority shall take appropriate decision on the representation moved by petitioner, as such, some reasonable time may be allowed to respondent no.2 in this regard.
In the above conspectus, without entering into merits of the case, writ petition is disposed of with a direction to respondent no.2 to consider the representation dated 05.11.2020 (Annexure 5 to the writ petition) moved by the petitioner and decide the same in accordance with law by passing an appropriate, reasoned and speaking order, after giving due opportunity of hearing to the petitioner, as
expeditiously as possible, preferably within a period of four weeks from the date of receipt of a copy of this order.
For a period of four weeks or till final decision on petitioner's representation, whichever period is earlier, no coercive action shall be taken against the petitioner in pursuance of bill of house tax dated 09.06.2020 for the financial year 2020-21 (Annexure no.3 to the writ petition).
