Heard learned counsel for the parties.

By the instant writ petition, petitioner seeks the following reliefs:

i) issue a writ, order or direction in the nature of mandamus commanding/directing the respondent no. 4-Sub Divisional Officer, Tehsil Chandausi, District Sambhal to take the action into the fair price shop allotment matter of the petitioner-Pragati Self Help Group, Village Lalpur Chenchari, District Sambhal as per the provision of Essential Commodities Act and its Rules as well as relevant Government Order in this regard, soon within stipulated period as fixed by this Hon'ble Court."

It is urged that in an open meeting of Gram Panchayat held on 25.11.2020 for allotment of fair price shop, a proposal in favour of the petitioner was passed. The fifth respondent-Block Development Officer, Block Baniyakheda, District Sambhal, vide communication dated 26.11.2020, addressed to the fourth respondent-Sub Divisional Officer, Tehsil Chandausi, District Sambhal, requested for allotment of the fair price shop in favour of the petitioner. It is urged that grievance of the petitioner is that the matter is pending for the last six months and no decision has been taken on the said proposal duly forwarded by the fifth respondent.

Learned Standing Counsel submits that the fourth respondent-Sub Divisional Officer, Tehsil Chandausi, District Sambhal, shall pass appropriate order, in accordance with law.

In view thereof, on consent, the petition is disposed of directing the fourth respondent-Sub Divisional Officer, Tehsil Chandausi, District Sambhal, to consider the grievance of the petitioner and pass appropriate order thereon, expeditiously, preferably within a period of eight weeks from the date of filing of certified copy of this order alongwith copy of the writ petition.

It is clarified that the Court has not considered the claim of the petitioner on merits.
