Heard learned counsel for the petitioner and learned Standing Counsel for the Staterespondents.
The present petition has been filed alleging that the proceeding initiated under section 24 of U.P. Revenue Code was allowed on 31.1.2019 by UpZiladhikari, Sadar, Azamgarh.
It is stated that in pursuance of the said order, it was recorded that the order dated 31.1.2019 has been implemented on 31.1.2020.
The counsel for the petitioner argues that despite recording the compliance the dispossession has not been got carried out and in this respect an application was filed by the petitioner before the respondent no. 4 which is pending consideration and has not been disposed of.
Without going into the question on merits of the order dated 31.1.2019 or the sufficiency of the compliance order dated 31.1.2020, the present petition is disposed off with liberty to the petitioner to file an appropriate application before the Sub-Divisional Magistrate, Tehsil Sadar, District Azamgarh (respondent no. 4) who shall take a decision thereupon strictly in accordance with law,
as expeditiously as possible, preferably within a period of four months from the date of production of a copy of this order.
The petition is disposed off in terms of the said direction.
Copy of the order downloaded from the website of Allahabad High Court shall be accepted/treated as certified copy of the order.
