Heard learned counsel for the petitioner and Shri Krishna Mohan Asthana, learned counsel representing the respondent no.2 and the learned Standing Counsel for the respondent no.1.
The instant petition has been filed seeking following relief:
(i) Issue a writ, order or direction in the nature of Certiorari quasing the impugned sale/auction notice dated 22.12.2020 issued by respondent no.2 (Annexure No.3 to this writ petition);
(ii) Issue a writ, order or direction in the nature of Mandamus directing respondent no.2 to provide statement of account of the petitioner and petitioner is ready to pay loan amount in one installment."
At the very outset, learned counsel for the petitioner submits that as the settlement arrived at between the petitioner and the respondent no.2, he does not intend to press the petition. Hence the petition may be dismissed as withdrawn.
In view of the above, the writ petition is dismissed as withdrawn.
