Ms. Rishu Mishra, learned counsel for the petitioner and Sri M.K. Shukla, learned counsel for the respondent nos. 1 to 6 and Ms. Archi Agarwal, learned counsel for respondent no. 7.

Learned counsel for the petitioner has confined her relief only to prayer no. 2. She submits that Bank guarantee was required to be submitted by the authorities as a pre condition for grant of work contract to the petitioner. The authorities after due verification have found that the petitioner complies with the requirements and after spot inspection issued an order dated 08.10.2020 for release of Bank guarantee. However, despite the order, the Bank guarantee has not been released in favour of the petitioner. She further submits that she has moved a representation dated 05.07.2021, which is pending consideration with the respondents.

Learned counsel for the respondent submits that the pending representation of the petitioner may be directed to be decided by the authority concerned.

In this view of the matter, without expressing any opinion on the merits of the case, the writ petition is disposed of directing the respondent no. 5 to decide the pending representation of the petitioner as expeditiously as possible preferably within three weeks from the date of production of certified copy of this order and pass appropriate order for release of Bank guarantee considering all the aspects of the case in accordance with law if there is no other legal impediment.
