Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.

Learned counsel for the petitioners submits that the impugned order dated 07.10.2021 has been erroneously passed by the respondent no.3, without affording any reasonable opportunity of hearing to the petitioners and, thus, the electricity bill has not been corrected.

Sri Udit Chandra, learned counsel for the respondent nos. 2 and 3 states on instructions that petitioners may file a representation-objection under Para 6.5 of the U.P. Supplies Code, 2005, which shall be decided by the authority concerned in accordance with law within a time bound period.

Learned counsel for the petitioners undertakes to submit a representationobjection under Para 6.5 of U.P. Supplies Code, 2005 within two weeks from today.

In view of the stand taken by the learned counsel for the parties, this writ petition is disposed off giving liberty to the petitioners to submit a representation-objection under Para 6.5 of U.P. Supplies Code, 2005 within two weeks from today alongwith certified copy of this order before the respondent no.3, who shall decide the objection-representation in accordance with law, within next two weeks, after affording reasonable opportunity of hearing to the petitioners.

For a period of four weeks or till the decision is taken by the respondent no.3, whichever is earlier, no coercive action shall be taken against the petitioners pursuant to the impugned order. The impugned order shall abide by final order which shall be passed by the respondent no.3 on the representation of the petitioner.

The petitioners shall continue to deposit the electricity bill.
