Heard learned counsel for the petitioners and the learned Standing Counsel appearing for the respondents.
This writ petition has been filed with the following prayer:
"(i) Issue a writ, a writ order or direction in the nature of mandamus commanding and directing respondents to pay the compensation of the acquire land in question being Gata Nos. 35 Ka, 35 Kha, 34 Ka, 34 Kha, 33 Ka, 33 Kha, 52, 56, 58 and 222 area situated in village and Pargana Dureni, Tehsil and District Banda in the light of right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 within stipulated period to be fixed by this Hon'ble Court".
The contention of the learned counsel for the petitioners is that the petitioners are bhumidhars of Gata Nos. 35 Ka, 35 Kha, 34 Ka, 34 Kha, 33 Ka, 33 Kha, 52, 56, 58 and 222 situated in village and Pargana Bhuredi, Tehsil and District Banda. It is alleged that over the land of the petitioners, bye-pass road has been created by the Executive Engineer, Prantiya Khand, Public Works Department, Banda, the respondent No.5 without taking consent of the petitioners.
When the matter was listed on 1.2.2021, learned Standing Counsel was directed to obtain instructions. Today, learned Standing Counsel has submitted instructions which have been taken on record and at page 2 thereof, the instructions are as follows:-

Since it is an admitted fact that the land of the petitioners has been utilized without due process, the compensation in respect of the same has to be paid as soon as possible without any delay to the petitioners.
Under the circumstances, it is directed that necessary formalities regarding agreement shall be completed and due compensation to the petitioner shall be paid, all within a period of three months from today.
With these observation, the petition stands disposed of .
