The instant writ petition has been filed for a mandamus commanding the respondent nos. 2, 3 and 4 to ensure delivery of possession of the properties to the petitioner, she being an auction purchaser of part of house no. K56/129 area 466.35 sq. ft. situate at Mohalla Ausanganj, Ward Kotwali, District Varanasi.
This court by previous order required learned Standing Counsel to obtain instructions as to why possession is not being delivered to the petitioner.
On matter being taken up today learned Standing Counsel Sri B.P. Singh Kachhawah states that the possession of the auctioned property has been delivered to the petitioner on 11.12.2021 which fact is admitted by the learned counsel for the petitioner. Consequently, nothing further survives to be decided in the instant matter.
The petition stands disposed of accordingly.
