No reply filed by President of Nagar Panchayat on private respondent. Be that as it may the State has also not filed reply.

By means of this writ petition, the petitioners are seeking following relief:-

(a) Issue a writ, order or direction in the nature of Mandamus directing the State Government to forthwith take into consideration the inquiry report having been sent by the District Magistrate on 31.03.2021 to the State Government for drawing action under Section 48 (2) (I) (IX) and (XI) U.P. Municipalities Act, 1916 to be taken within stipulated period of time as this Hon'ble Court may so deem fit and proper in the facts and circumstances of the case.

In Such view of the matter, without expressing any opinion on the merits of the case, we dispose of this writ petition finally, with a direction to the State Authorities concerned to take into consideration the inquiry report pending before him, as expeditously, provided there is no legal impediment.

Petitioners are obliged to furnish a copy of this order before the authority concerned.
