Heard Shri Indrakesh Kumar Sharma, learned counsel for the petitioner and the learned Standing Counsel for the respondent-State.

The writ petition arises out of proceedings taken out under Section 34/35 of the U.P. Revenue Code, 2006 by the petitioner which came to be registered as Computerized Case No.T201817650205669, Smt. Sonmati Devi Vs. Tilak @ Ram Tilak, before the learned court below.

Learned Standing Counsel on the basis of instructions submits that the private defendants to the said proceedings have entered appearance before the learned court below and tendered their objections. On the basis of instructions it is further stated that delay is being caused on account of the petitioner. The petitioner has failed to submit the sale deed despite repeated opportunities being given for the same. The instructions are taken in the record.

Faced with this, Shri Indrakesh Kumar Sharma, learned counsel on behalf of the petitioner submits that the petitioner shall submit the sale deed within a period of 10 days from today before the court below and the petitioner shall cooperate with the proceedings before the court

below.

In case the sale deed is submitted in the aforesaid stipulated period and if there is no legal impediment, the court below shall proceed with the hearing of the case, registered as Case No.T201817650205669, Smt. Sonmati Devi Vs. Tilak @ Ram Tilak. The court below shall decide the said case after noticing and giving opportunity of hearing to all parties to the lis in accordance with law preferably within a period of three months from the date of receipt of a copy of this order downloaded from the official website of the High Court of Judicature at Allahabad. The concerned Court/ Authority/ Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.

With the aforesaid direction, the writ petition is disposed of finally.
