The petitioners vide this writ petition under Article 226 of the Constitution of India seeks direction to respondents no. 3 and 4 viz Additional District Magistrate (Finance and Revenue)/Special Land Acquisition Officer, Kanpur Dehat and the National Highway Authority to make payment of compensation in respect of 148 sq. meter of Plot No. 616 situated at village Sikandra Nagar, Tehsil Sikandra District Kanpur Dehat.
It is urged that the petitioners are real brothers and the owner of plot no. 616. It is urged that the land forming part of plot no. 616 and 617 was subjected to acquisition under the Act of 1956 for widening of National Highway No. 2 Etawah-Chakeri section. It is contended that on 17.11.2016 award was passed in respect of land admeasuring 0.0820 hect. of plot no. 616 and 0.0400 hect of plot no. 617. It is urged that in the year 2014 petitioner brought proceedings under section 28 of the Revenue Code before Collector, Kanpur Dehat for correction of map of plot no. 616 and 617 as a result whereof some more land was added to plot no. 616 which measured 148 sq. mt. and only compensation in lieu of
0.0820 hect was granted. This fact it is contended was duly forwarded by the Tehsildar to respective authorities which evoked an opinion from the Competent Authority Addl. Collector(Finance/ Revenue) Kanpur Dehat on 14.2.2020 whereby the Project Director, National Highway Authority of India was called upon for justification of award. The precise opinion was in the following terms:
"मेरे द्वारा जि�लाधि�कारी न्यायालय द्वारा पारिरत आदेश दिदनांक 28-07-2016, तहसील आख्या, नक्शा एवं अन्य अभि!लेखों का परीक्षण करने से यह स्पष्ट होता है दिक गाटा संख्या 616 मे गाटा संख्या 617 से रकबा 0.0148 हे० की बेसी होने के उपरान्त हाइवे पर गाटा संख्या 616 में 0.0148 हे० !ूदिम बढ़ गयी है, जि�सका प्रधितकर गाटा संख्या 616 के कास्तकारों को देना होगा। तथा गाटा संख्या 617 से अधि�ग्रहीत रकवा 0.0400 हे० में रकवा 0.0148 हे० की कमी होने के उपरान्त अधि�ग्रहीत रकवा 0.0252 हे० ही बचेगा, जि�सके लिलये अभि!दिनण:य में संशोधि�त दिकया �ाना आवश्यक है।
कृपया तद्नुसार संलग्न अभि!लेखों का अध्ययन कर अपना मन्तव्य उपलब्� कराने का कष्ट करें तादिक उक्त प्रकार की समस्या का समा�ान दिकया �ा सके।"
It is this very opinion inspired wherefrom the petitioners have preferred this petition.
That instructions/response was sought from the respondent which since been filed wherefrom it is borne out that no extra land beyond 0.0820 hect of plot no. 616 was utilized for construction of National Highway relying on the order of Collector, Kanpur Dehat passed on 28.7.2016 on an application for correction of map, it is urged that even Collector did not record any addition of land to plot no. 616. That operative portion of order dated 28.7.2016 spells out thus:
"पत्रावली पर उपलब्� तहसील आख्या के गहन अवलोकन एवं दिवश्लेषण से स्पष्ट है दिक प्रश्नगत गाटा संख्या 616 का बन्दोबस्ती रकबा 0.379 हे० है, परन्तु श�रे में बनी आकृधित के अनुसार उसका रकबा 0.313 हे० अथा:त्

बन्दोबस्ती क्षेत्रफल से 0.066 हे० कम पाया गया, जि�सकी पूर् त ि हेतु गाटा संख्या 617 जि�सका बन्दोबस्ती रकबा 2.487 हे० है तथा श�रे के अनुसार 2.647 हे० है अथा:त बेशी रकबा 0.160 हे० गाटा संख्या 616 में शादिमल करने से उसकी प्रधितपूर् त ि हो सकती है। तहसील आख्या के अाख्या के अवलोकन से यह !ी स्पष्ट है दिक मौके की स्थिस्थधित के अनुसार गाटा संख्या 616 के शेष रकबा 0.066 हे० की प्रधितपूर् त ि दिकया �ाना सम्!व है। गाटा सं० 616 की पूरब की मेड़ उत्तर दधिक्षण तोड़कर गाटा सं० 617 में उत्तरी व दधिक्षणी मेड़ पूरब पधिPम 100 कड़ी के बाद उत्तर दधिक्षण 130 कड़ी की मेड़ बना दी �ाय तो गाटा सं० 616 की आकृधित द�: रकबे के अनुरूप हो �ायेगी तथा गाटा सं० 617 की आकृधित !ी कम नही होगी और न ही दिकसी प्रकार का दोनों गाटों के कास्तकारों पर कोई प्र!ाव पड़ेगा। ऐसी स्थिस्थधित में , श�रे को संशोधि�त दिकया �ाना न्यायोधिचत प्रतीत होता है। तहसीलदार जिसकन्द्रा की आख्या दिदनांदिकत 28.10.2014 के आलोक में वादीगण का वाद स्वीकार दिकए �ाने योग्य है।
आदेश
उपयु:क्त दिववेचना के आ�ार पर वादीगण का वाद स्वीकार दिकया �ाता है। तदनुसार ग्राम जिसकन्द्रा नगर, तहसील जिसकन्द्रा �नपद कानपुर देहात के श�रे में संशो�न दिकए �ाने के आदेश दिदए �ाते हैं। तहसीलदार जिसकन्द्रा की आख्या दिदनांदिकत 28.10.2014 इस आदेश का अंग होगी। आदेश की एक प्रधित तहसीलदार जिसकन्द्रा को अनुपालन हेतु प्रेदिषत की �ाए। पत्रावली बाद आवश्यक काय:वाही दालिखल-दफ्तर हो।"
It is further contended that joint inspection was even carried out by a team constituted by Tehsildar, Sikandara, Kanpur Dehat which gave its report on 24.1.2021 in the following terms:
"उक्त आदेश के अनुपालन में वत:मान !ू -धिचत्र में आदेश का अंकन कर दिदया गया है। मौके का स्थलीय दिनरीक्षण दिदनांक 23-10-2021 को दिकया गया, जि�समें पाया गया दिक गाटा संख्या 616 में मौके पर अधि�ग्रहीत रकवा 820 वग: मीटर व गाटा संख्या 617 में अधि�ग्रहीत रकबा 400 वग: मीटर में मौके पर

!ारतीय राष्ट्रीय रा�माग: प्रधि�करण द्वारा सड़क का दिनमा:ण व रिरक्त पड़ी !ूम पर ट्री-गार्ड: लगाकर व खूंटी गाड़कर दिनशानदेही कर ली गयी है। गाटा संख्या 616 में 0.0832 हे० !ूदिम वत:मान उद्वरण खतौनी में राज्य सरकार के नाम !ी द�: है। गाटा संख्या 617 में अधि�ग्रहीत !ूदिम के अधितरिरक्त खातेदारों की शेष !ूदिम में दिपलर व फसल खड़ी है।"
On the basis whereof, it is contended that the Project Director, National Highways Authority of India vide communication dated 25.1.2021 informed the Competent Authority Land Acquisition that as no extra land of plot no. 616 is acquired, no further award is warranted. On these contentions it is urged that the petitioners have no right of compensation for 148 sq. mt. alleged to part of plot no. 616.
Considered rival submissions.
The question is whether extra 148 sq. mt. of land was allegedly added to the area of Khata No. 616 was acquired by the Authority concerned.
The Project Director in its communication dated 25.1.2021 has categorically stated that the plot no. 616 comprised of 0.0820 hect. whereon service lane is constructed and there is no extra land of said plot. The said finding is based on the joint inspection report. We deem it appropriate to reproduce the express opinion of the Project Director:

इस संबं� में अवगत कराना है दिक गाम - जिसकंदरा नगर, तहसीलजिसकंदरा �नपद-कानपुर देहात के गाटा सं० 616 एवं 617 के संबं� में दिदनांक 23.01.2021 को संयुक्त टीम तहसीलदार महोदय, जिसकंदरा, क्षेत्रीय लेखपाल, श्री संतदिमलन (रा�स्व सहायक), एनएचएआई काया:लय के श्री मनबो�न (रा�स्व सहायक) द्वारा स्थल दिनरीक्षण दिकया गया है। जि�समें जि�लाधि�कारी महोदय के नक्शादुरस्ती आदेश दिदनांक 28.07.2016 से संशोधि�त नक्शे के आ�ार पर गाटा सं०-616 का दिनरीक्षण दिकया गया। गाटा सं० -616 �ो मौके पर !ारतीय राष्ट्रीय रा�माग: के समानान्तर दिदशा में स्थिस्थत है। उक्त गाटा सं० 616 में अधि�ग्रहीत रकबा 0.0820 पर !ारतीय राष्ट्रीय रा�माग: की सर् व िस लेन का दिनमा:ण हो चुका है। सड़क के समानान्तर राज्य सरकार की !ूदिम को !ी तहसीलदार महोदय जिसकन्दरा द्वारा खाली कराया गया है। उक्त दिनशानदेही के पPात् यह स्पष्ट है दिक गाटा सं० 616 में 0.0820 हे० में !ारतीय राष्ट्रीय रा�माग: की सर् व िस लेन दिनर्विमत है। उक्त के अधितरिरक्त अन्य !ूदिम की आवश्यकता गाटा सं०- 616 से नहीं है। अर्जि�त की गयी !ूदिम पया:प्त है। गाटा सं०- 617 के अधितरिरक्त अभि!दिनण:य की आवश्यकता नहीं है।

That except an opinion by the Authority, Land Acquisition which apparently is not based on any inspection report by a Competent Authority such as Tehsildar, the petitioner asserts adding of area to

Khata No. 616, however, we do not perceive any merit in the contention that with the correction of map extra land came to be added to plot no. 616.
As no extra land of Khata No. 616 is acquired, the petitioner is not entitled for the relief sought.
Consequently petition fails and is dismissed.
No costs.
