Heard learned counsel for the petitioner, learned Standing Counsel on behalf of respondent no.1 and Shri Sandeep Kumar Singh, learned counsel appearing on behalf of respondent no. 2.
The instant petition has been filed seeking following reliefs :
"(i) Issue writ order and direction to the respondent Bank authority provide the statement of Bank account No. 00820400000060 of M/s. Flora International and issue the no dues certificate in pursuance of the said Bank Loan if remaining amount was deposited by the petitioner,
(ii) Issue writ order, or direction to the concern Bank authority/respondent No.2 also decided the representation dated 18.11.2020 with in stipulated period."
Learned counsel for the petitioner submits that the petitioner had earlier approached this Court by filing Writ-C No.-42001 of 2019 which was disposed of on 18.12.2019 with a direction to the petitioner to pay the dues amount to the respondent bank in easy installments. She has deposited the amount in terms of the said order, however, she has not been apprised about the balance amount to be paid in installments and now the bank is demanding additional Rs.9 lakhs. He further submits that the petitioner has already deposited the due amount of Rs.9,24,830/- and she is ready to pay the balance amount, if a statement of account is provided by the bank.
Learned counsel for the respondent bank has supplied an statement of account in the Court to the learned counsel for the petitioner.
In the facts and circumstances of the case, without going into the merits of the case, this writ petition is disposed of granting liberty to the petitioner to approach before respondent no. 2 within two weeks from today along with a copy of this order and the respondent no. 2 shall consider and take appropriate steps regarding payment of the due amount as directed earlier.
