By the impugned order dated 25.11.2020 the Deputy Director of Consolidation has remitted the matter to the Consolidation Officer for fresh adjudication. The parties may tender their evidence before the Consolidation Officer. The Consolidation Officer has been directed to decide the proceedings within a period of six months. These directions have been passed on the foot that the orders of the court below were in violation of the principles of natural justice, and in the absence of evidence which some disputant parties were intending to tender. The opportunity to adduce evidence to the said parties was denied.
There is no infirmity in the impugned order.
Faced with this Sri Anirudh Kumar Upadhyay, learned counsel for the petitioners does not press the relief sought in the writ petition. He recasts his relief and prays that the proceedings before the Consolidation Officer be concluded expeditiously.
He submits that the petitioners undertake to join the proceedings before the Consolidation Officer and render all cooperation to ensure that the proceedings are concluded on their merits within the time period stipulated in the order passed by the Deputy Director of Consolidation.
Sri Ram Jeet Mishra, learned counsel for the respondent no. 3 does not have any objection to the aforesaid prayer for concluding the proceedings in the time period stipulated in the impugned order dated 25.11.2020.
Sri Ram Jeet Mishra, learned counsel for the respondent no. 3 also undertakes that he shall not seek unnecessary adjournments before the learned trial court and shall cooperate with the proceedings to ensure that the proceedings are concluded within the time line stipulated by the Deputy Director of Consolidation in the impugned order.
Sri Bhupendra Kumar Tripathi, learned counsel for the Gaon Sabha is present.
The writ petition is disposed of.
