Heard learned counsel for the petitioner and Sri S.K. Gupta, learned counsel for respondents no. 2 and 3.
The present petition has been filed alleging that the petitioner was working as a Headmaster and retired on 30.6.2008 after attaining the age of superannuation and was entitled to his retiral dues immediately as on retirement.
It is stated that most of the retiral dues have been paid, however, the amount of GPF was paid only upto Rs. 1,17,072/-. It is claimed that despite the fact that the petitioner was entitled for entire GPF amount. Only a sum of Rs. 1.17,072/- was paid to the petitioner and the balance amount of GPF amounting to Rs. 86,202/- was paid to the petitioner after abut 11 years on 21.2.2019. It is on this amount the petitioner has claimed that he should be paid the interest. He has placed reliance upon the judgement of this Court to the effect that interest is natural accredition of capital and should be paid in case of delay.
Accepting the prayer, the writ petition deserves to be allowed.
Respondents are directed to pay the interest at the
rate of 8% per annum from 01.7.2008 upto 21.2.2019 on the delayed payment of Rs. 86,202/within a period of two months from today.
The writ petition stands allowed in terms of the said direction.
