Heard learned counsel for the petitioner, learned Standing Counsel for respondent no.1 and Sri Ravindra Singh, learned counsel for respondent nos.2 to 6.
The petitioner by means of the present petition has sought a direction upon respondent no.6 to release the unpaid retiral dues of Ajay Kumar Srivastava, who was working as Clerk in Cane Cooperative Development Society, Pratappur, Deoria.
It is submitted by the learned counsel for the petitioner that pursuant to order of this Court in Writ-A No.1667 of 2019, respondent no.6 has released certain retiral dues but has not released entire retiral dues. In this respect, petitioner has submitted a representation to respondent-authority on 18.12.2020, copy of which is annexed as Annexure 8 to the writ petition, but respondent-authority has not considered his representation.
Learned counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.6 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with liberty to the petitioner to file a fresh representation before the respondent no.6- Secretary, Cane Cooperative Development Society Ltd. Pratappur, Deoria, raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.6 shall decide the same by reasoned and speaking order within a period of eight weks thereafter.
The writ petition is disposed of subject to the observations made above.
